Hey there and welcome to our privacy statement! Where does this privacy statement apply?

-It applies to your activity on websites and mobile apps controlled by American Dairy Queen Corporation (based in the U.S.) and Dairy Queen Canada Inc. (based in Canada). We’ll call these website and mobile apps the “Sites” in this statement.

– Most DQ and Orange Julius® locations worldwide are independently owned and operated franchises, and some of them have their own websites, email clubs, or mobile apps – we don’t own, operate, or control any of those and this privacy statement doesn’t apply to those. Also, when you search for a location, some of our locations have a “Careers” link that allows you to send your résumé to that franchise. This information doesn’t come to us at the corporate headquarters. It is sent directly to the franchisee.

-If you follow a link on any of our Sites to any third party website – say, to purchase gift cards or branded gear – you’ll be leaving the realm of this privacy statement. You aren’t banished – you can come back anytime, but you should check out the privacy policies of those other sites to find out how they treat your data.

-Your personal information may be processed and stored in the U.S., Canada, or another country where privacy laws may be less stringent than the laws of your country, and the government, courts, law enforcement or regulatory agencies of these countries may by law be able to obtain your personal information.

-By using the Sites, you are agreeing to this privacy statement. We may change it and when we do, continuing to use the Sites means you agree to the changes.

Collection

We collect Personal Information (any information about an identifiable individual) in several different ways.

Information You Submit

-Fan Clubs

What? When you sign up for the Blizzard® Fan Club or Julius League®, you give us your country, zip code, name, birth month and day, and email address. If you sign up for the Blizzard Fan Club, we also ask for your favorite Blizzard Treat flavor!

Why? Well, your name and email address help us communicate with you about new fancy flavors, Blizzard Treats of the Month, and all that – along with some pictures we hope make you drool! And your zip code, well, this helps us figure out where we have lots of fans so we can make better decisions about marketing, and where we might need to build new locations! We use your country to make sure you are getting product info relevant to you, as we have some different menu items in the US versus Canada (poutine anyone?). We use your birth day and month to send you a special message on your special day. We love to recognize our fans!

-Digital Ordering (U.S. and Canada). What’s digital ordering? When we talk about digital ordering, we mean ordering via the DQ® mobile app or online through dq.com or dq.ca.

What? Here’s the lowdown on what we collect when you create an account for digital ordering. We collect your name, email address, and a password. Or you can create an account using the “Sign in with Apple” or “Log in with Facebook” options. For those options, we get info from Apple or Facebook such as your name, email address, and user ID to make it easier for you to create an account and to potentially show you relevant content from your Facebook friends. The info we get from Apple or Facebook depends on your privacy settings, so please be sure to check out their privacy and data practices. When creating your account, we’ll also collect your telephone number, birth month/day, and favorite DQ® location. Fans can also use digital ordering as a guest user without creating an account at all. If you do that, we don’t get data via account creation, but by using digital ordering, we still collect info in other ways described in this privacy statement.

Why? So, we use your name to create and track your account and to identify you as a user in our system. Your email address? Well, to send you a welcome email for verification purposes (and because it’s the neighborly thing to do!), for administrative notifications (things like order confirmations, security advisories, or support and maintenance notices), to ask for your feedback, and to contact you about deals, loyalty, and other promotional emails (depending on your selections when you signed up). We collect your telephone number so that if there is a problem with your order, you can be contacted to iron it out, and if you elect to receive text messages from us, you may get promotional messages (new offers, deals and cool stuff like that) and transactional messages (order confirmations, receipts, yada yada yada). Your password? Well, to keep your account secure! That’s better than trying to figure out how to attach a padlock to your loyalty points, right?! Last but not least, we ask for your birth month/day so we can send you sweet birthday offers! Also, we use different pieces of all of this data to get you the products and services you request (like the scrumptious food and treats you order), and for general things like improving the administration of, and your experience with, the digital ordering platforms.

What else? There’s some other data we collect as you interact with our digital ordering platforms. If you’re using our mobile app, have location services enabled on your mobile device, and agree to location data collection when prompted by the mobile app, we’ll have access to your location when you’re using our app. Our digital ordering platforms also collect information about how you use them – things like your order information and history, check-ins, deals redemption, and other stuff like that. However, any payment info goes directly to our payment processor and we don’t ever see it.

Why? Well, we use your location info to find DQ® restaurants near you, to know if you are close to picking up your order, and to tailor deals depending on your location. And we collect your order information and send it along to the DQ® restaurant fulfilling your order so you can get the delicious food and treats you ordered! We use your order history to make it more convenient for you to place additional orders in the future, and when you check-in at a DQ® location, we use the data to assign loyalty points to you. And we use deals redemption info to make sure you get the deal you are using! Lastly, we may use all of this data to analyze trends, administer the digital ordering platforms, monitor for fraudulent activity, etc., etc. so that we can continue to improve our Sites and products and services.

Anything else? Sometimes we also create anonymous information records by excluding data that makes the info identifiable to a specific person (stuff like your name or email address). We use this anonymous data to analyze request and usage patterns to enhance our Sites, products and services.

-Contests or Sweepstakes

What? Sometimes we run contests or sweepstakes through the Sites, social media, or other fun advertising channels. When we do that, we may also ask if you want to be added to one of our fan clubs. If that happens, just bop back up to the fan clubs section to understand the what and why of our collection. If you don’t agree to be added to our fan club, then your information is kept until after the sweepstakes or contest ends (so we can choose winners and send the fun prizes). We may ask for different information for each contest or sweepstakes, because, well, each is unique! That’s what makes them so fun! We’ll let you know in the contest or sweeps rules what information we’re collecting, but all the info about how we handle the information is found right here in this privacy statement.

Why? We collect this information so that we can choose a winner or winners, and to fulfill prize obligations.

-Quikly Giveaways

What? We may run promotional giveaways called Quiklys through a third-party vendor. For these, the info gathered may be different depending on the giveaway, but we’ll always collect your email address, and potentially also your first and last name, phone number, and shipping address.

Why? We collect the information to notify potential winners, award the super-fun Quikly promotional items, and conduct marketing analysis. In addition, when we collect the information, we may notify you that we’ll use it for marketing purposes in exchange for the free giveaway item. -Product Surveys

What? We love making sure the new products we are mixing up are tasty and delicious and what you want! To keep us on the right track, we’ll sometimes run surveys. We have a couple different kinds. We may ask our fan club members about what they like or dislike, and in that we collect different sorts of information. We also sometimes test new products at certain super-secret locations and if you are lucky enough to catch one of these test products, we’ll ask you to complete a survey about the product. For these product surveys, we ask for your email address, age range, and gender. When you complete a test product survey, we’ll also ask if you want to be added to one of our fan clubs. If that happens, head on back to the fan clubs section to understand the what and why of our collection. Participation in surveys is always voluntary, and the data is anonymized soon after and personal information deleted.

Why? We collect this information so that we can improve our products or our marketing. For test product surveys, we collect your email address so we can offer you a coupon for helping us out, and we ask for your age range and gender to help us ensure the product we’re testing has a wide range of consumer appeal. The individual data gets rolled up into statements like “this flavor skews 60% female” or “this product skews towards millennials.”

-Experience Surveys

What? We love making happy for our fans! To see if our fans are having good experiences, you may be asked on your receipt to complete a survey after your visit. Depending on how you describe your experience, we may ask if you want to be contacted by the franchisee of the location you visited and collect your name, phone number, and email address.

Why? Your information will be shared with the location you visited so they can reach out to you about your experience since they are in the best position to make it right! We also use the data to track info about the most common issues, resolution time, etc. as we continually strive to improve service!

-DQcakes.com 

What? When you order a cake, we collect your name, phone number, and email address, as well as details about your cake order.

Why? So you get the cake you ordered! The restaurant fulfilling your order will have access to your information to communicate with you about your order. We also use your cake order information for marketing purposes and aggregate it so that we can figure out things like what cake flavors and toppers are most popular.

-Product Offers

What? It may sound a little odd, but we generally don’t offer products directly to our fans. As we mentioned earlier, most DQ and Orange Julius locations are independently owned and operated franchises, which means it’s the owner of each store that is selling delicious products. In addition, the “Gift Cards and Gear” link on our website is run by a licensed third party vendor. Every once in a while though, we decide there is a special enough opportunity that we want to offer special products to our fans. A great example of this is our limited time offer fall Sweeter Vest. How will you know that we are running the offer instead of a third-party vendor? Well, the easiest way is to check out the privacy statement on the website. If it links to this one right here, then you know! In these situations, we generally collect your name, email address, phone number, and shipping address.

Why? We collect your email address and phone number so we communicate with you about your order, and your name and shipping address so we can have your order sent to you.

-Fan Relations Interactions

What? When you use the “Contact Us” page on our Sites, you give us your name, postal address, phone number, and email address. We’ll also ask for details about why you are contacting us. If you call us, we’ll ask for the same info.

Why? We’ll use the information to help you with your comment, question, or concern because we really want to make sure that our fans are treated right! If you have a comment about a specific location, we’ll send your information to the location that handled your experience – they’re the ones who are in the best position to make it right!

Reminder: Most of our locations are independently owned and operated franchises – we recommend that you contact them first, because they can usually address your concern or celebration more directly. We don’t control any of their privacy practices.

-Developing a Franchise

What? When you use the “Own a DQ Location” page on dairyqueenfranchising.com (for US or Canada), you give us your name, postal address, phone number, email address, and information about your net worth and capacity for investment. Or for international opportunities, if you contact us via email or phone (such as at internationaldevelopment2@idq.com or at another email address or phone number) you may give us your name, email address, and phone number.

Why? We use this information to help us decide if your business meets our minimum requirements for new franchisees, to help us prioritize interested businesses, and to contact you about available opportunities if it looks like a good fit. Like any good relationship, we may want to get to know each other more, and so we may ask you to fill out an application or provide more information about your qualifications, which may include current and previous home address, employment information, detailed financial information, marital status, and spouse’s name. Once everyone is feeling confident with the relationship and ready for a commitment, then a different privacy statement applies to franchisees.

-Children

We know kids are some of our biggest fans! But we want their personal information to stay in the safest place – with them or their parents. We don’t intentionally gather personal information about our fans under age 13, and please do not share personal information relating to anyone under the age of 13.

Information Collected or Used Automatically

-IP Address

Say what? Your IP Address (“internet protocol address”) is a unique series of numbers that is assigned by your internet provider to the device you’re using to access the internet. Want to know yours? Type “What’s my IP address?” into most web search tools and you’ll find out! We may collect your IP address automatically as you navigate the Sites.

Why? Your IP address can be used to give us a general idea of where you are accessing the Internet (kinda like a zip code rather than a specific lat/long). We collect it so we can tailor our messaging to your location. For example, once we know if you are in the US or in Canada, then we can show you the products that are offered in that country. Or when you open one of our fan club emails we can customize the message to your general location. We may also use your IP address for things like analytics, security, and fraud prevention. For example, if you take one of our product or experience surveys, the survey vendor may collect your IP address to keep track of which IP addresses have already done the survey.

-Cookies (in my Blizzard® Treat?). No, not those kind of cookies.

What? Cookies are tiny pieces of code that your web browser stores.

Why? They help us show you the kind of content that you probably want to see and remember you so you don’t have to keep entering the same information. For example, if you choose the Canadian version of Site, a cookie remembers that, and will show you the Canadian version the next time you visit. Or if you create an account for digital ordering on our Sites, the cookie will remember you for a short period of time so you don’t need to sign in again if you navigate away from the page. We don’t store any of this data in a way that connects it to a specific person.

-Other Cookies in the Jar

What? Facebook feeds your browser a cookie when you visit our Sites. You can read more about how Facebook uses data here: https://www.facebook.com/policy/cookies/. You can also get to this page by navigating to Facebook’s page and looking for the link to “Cookies” at the bottom of the page.

Why? So that your browser can request our ads (amongst other ads, requested by your browser because of different cookies it’s eaten on other websites you’ve visited) when you visit Facebook.

What else? Some of our advertising service vendors may also feed your browser cookies when you visit our Sites.

Why? In order to help us tailor advertising to you when you visit other websites, and to provide us information about how our fans interact with our advertising and how it relates to traffic on our Sites.

Anything else? Many companies use cookies that track your activity across different websites and collect information about how you interact with content and advertisements. Your computer snacks on these cookies as it visits different websites on the internet. Some of our vendors track information about how fans interact with our advertisements when they see the brand representin’ on another page, but they don’t collect information associated with a specific fan – they collect stuff like “how many clicks did this ad get on this site.”

You don’t like cookies? Hey, we make treats for all kinds! If you would rather not have these cookies, you can use your browser’s cookie settings to control which cookies your browser eats! This is usually managed through a “Settings” menu, although you may have to delve into the “Advanced” segment. You can also control more about how many cookies are a part of your browser’s balanced diet by looking into the YourAdChoices program from the US Digital Advertising Alliance or the Digital Advertising Alliance of Canada, or the Network Advertising Initiative’s opt-out page.

-Third Party Analytics

What? We use analytics service vendors like Google Analytics and Google Analytics for Firebase. To do this, Google may use cookies, an IP address, a device ID or similar technologies, but at the end, Google provides us a report with no personal information in it. You can find more information about how Google Analytics uses data at this link, including how to control the info collected by Google: https://policies.google.com/technologies/partner-sites. You can also potentially opt-out of the analytics features we use through your device settings, such as the device advertising settings for mobile apps.

Why? We use these services to help us analyze how fans use our Sites, to understand how people find and get to our Sites, what people are looking for when they visit us, what ad campaigns help us entice fans to our restaurants, and how we could make our Sites better.

-Info Collected By Our Servers

What? Our servers may automatically collect info about how our fans use and interact with our Sites.

Why? We use this information to analyze trends, administer the Sites, monitor for fraud and for the effectiveness of our fraud management tools, and to better tailor the Sites to your needs. This info also helps us make better decisions about everything, from what kind of Blizzard® Treats are super popular, to how much support we need for really old browsers.

-Info Collected From Your Device

What? We may automatically collect information from your device, such as device type, device ID, device carrier, browser type, operating system, and other stuff like that.

Why? This data helps us identify and fix bugs and otherwise improve the performance of our Sites.

Sharing is Caring

. . . but sometimes less is more. We don’t really like sharing information, but sometimes we just gotta! So who do we share with?

One big happy company family. 

We share data within the DQ®/Orange Julius® family of companies, mostly because we all work together out of the same office spaces and try to streamline where we can.

Franchisees. Most of the time, your information stays here at our corporate headquarters. But, as we mentioned earlier, most of our locations are independently owned and operated franchises, which means that sometimes the best one to take care of you is the franchisee who owns your local restaurant! We share some information with our franchisees when you order a cake or place a digital order, when you get in touch with our Fan Relations team about a celebration or a concern related to a specific location, and we’ll share some info from an experience survey if you tell us you want to be contacted by the location about your experience.

Vendors. We’re actually a pretty small team around here, so we get a little help from our friends. These are companies with pretty specialized skills, and any company who gets personal information about you from us has agreed that they’ll only use your personal information for helping us with the services they’ve been hired to provide. These vendors may help us with things like hosting, data management and storage, marketing or remarketing, website or marketing analytics, email services for our fan clubs, services to assist us with responding to you if you contact us, for contest or sweepstakes administration and fulfillment, for employment application processing, surveys, product fulfillment, quality assurance testing, digital ordering services, processing payments, technical support, and other similar services. In addition, our vendors may collect any of the information listed in the “Information Collected or Used Automatically” section while they are providing us with the services they have been hired to do. And, we may sometimes share anonymized or deidentified data with our vendors and other third parties. But note, your mobile telephone number obtained from the text message opt-in on the mobile app won’t be shared with third parties for their own marketing purposes.

Police & legal stuff. We will share information if we are required to by law, or if we need to in order to cooperate with an investigation or defend our family of companies, our vendors or our franchisees, or to prevent fraud, a violation of this privacy statement or our terms of use.

New owners. Hey, we’d be just as surprised as the next fan, but if we merge, sell, reorganize in our corporate family, or otherwise dispose of a portion of our business assets, we may pass on your personal information as part of the deal.

Manage Your Data

How can you control your data?

-Email. You can click the link at the bottom of any email that comes from us to unsubscribe from promotional emails from email list, or to correct your info for that email list. But, fair warning, we may still email you for transactional purposes for stuff like providing you updates about your orders, receipts, etc., or as otherwise permitted or required by law.

-Digital ordering. You can stop all future collection of information by the digital ordering platforms by uninstalling the mobile app or no longer using online ordering on dq.com or dq.ca. To uninstall the mobile app, use the regular uninstall process for your mobile device.

-Mobile app location data. If you don’t want the mobile app to collect your location information, you can either decline the collection when downloading the app or disable location services on your device.

-De-linking Apple or Facebook. If you no longer want your Apple or Facebook account to be linked to your digital ordering account, visit Apple’s or Facebook’s privacy settings to adjust your permissions and to manage how they interact with your DQ® digital ordering account. If you no longer want to use Apple or Facebook to log into DQ® digital ordering, you’ll need to log out of digital ordering after adjusting your settings.

-Deletion, access or correction. If you are a California resident, visit the “California Disclosures” section below to find out how you can ask us to correct or delete your info, to ask us for the types of information we have about you, or for the specific pieces of that information.

California Disclosures

For our fans from California…

Do Not Track. California’s Business and Professions Code section 22575 requires us to disclose how we respond to “do not track” signals. Because there’s no consistent technology to respond to these types of signals (kinda like getting an alien signal from across the galaxy), we currently don’t take action to respond to these types of signals.

Sharing For Direct Marketing. Under section 1798.83 of the California Civil Code, California residents have the right to request certain information about the types of personal information the business shares with third parties for direct marketing purposes and the identities of the third parties with whom the business has shared such information during the preceding calendar year. You need to have an established business relationship with us to request this information, so if that describes you and you are interested in this info, you can reach out to privacy@idq.com or cacustomer@olo.com if you are a mobile app user.

Privacy Rights. The California Consumer Privacy Act (CCPA) provides verified residents of California with rights around their personal information.

-Right to Access. You have the right to request access to the categories and specific pieces of personal information that we have about you.

-Right to Information. You have the right to request access to:  
    • The categories of personal information we have collected about you.
    • The categories of sources from which the personal information was collected.
    • The business or commercial purpose for collecting or selling personal information.
    • The categories of third parties with whom we share personal information.
    • The specific pieces of personal information we collected about you.
 
-Right to Delete. You have the right to ask us to delete any personal information that we have collected about you. If required by law we will grant a request to delete information, but you should note that in many situations we must keep personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes.

-Right to Non-Discrimination. You have the right to not be discriminated against for exercising any of your rights under the CCPA.

Method for submitting requests. To exercise any of your rights under the CCPA, please fill out the form at this link or call 1-866-793-7582 to submit a request. When you submit a request, you will need to provide your name, email address on your account, state, country, and details about your request. We all have multiple email addresses, right? Well, we need it to be from the email address on your account because that’s how we verify that it is a legitimate request. Then we’ll send you an email asking you to click on a link to confirm it’s really you. We want to make sure we are taking actions that you requested (instead of your uncle’s best friend’s daughter’s neighbor named Carl).

► Pro-tip: We love to hear from our fans! But the link above is pretty specific to privacy stuff, so if you have non-privacy questions or comments, you’ll have a much better experience reaching out to our fabulous fan relations team using this link instead.

Info we’ve collected in the last 12 months. The personal information we have collected about California consumers in the past 12 months is described in the “Collection” section of this statement. This information includes personal information in the following categories:
  • Identifiers. These identify you as a person, such as your name, postal address, email address, or IP address.
  • Commercial information. Purchasing history and other similar info.
  • Internet and other electronic network activity information. Data like browsing or search history.
  • Geolocation data. Such as location data collected from your mobile phone for the mobile app.
  • Inferences. This sounds a little vague, but basically it means that we may take all the information we have about you and make some inferences about your preferences (um, you’d much prefer that Blizzard Treat flavor oozing with chocolate, amirite?).

We collect this information from you directly, either when you give it to us or one of our vendors, or automatically when you interact with our Sites. And the purposes for collecting this information and the categories of third parties with whom personal information are shared are all described earlier in this privacy statement.

Sharing Information and Right to Opt-out. The categories of personal information that we have disclosed for a business purpose are identifiers, commercial information, internet or other electronic network activity information, geolocation information, and inferences. We don’t sell any personal information under the definition of Section 1798.140(t) of the CCPA, therefore, you don’t have to do anything to opt-out of the sale of information.

Have an agent? No, not the secret spy kind of agent. We know you are a busy person, so if you have an authorized agent to exercise any of your CCPA rights, they should use the same method for submitting a request for your email address as explained above. Your agent can attach their authorization or power of attorney to the request. For the security of your information, you’ll get an email asking you to click on a link to confirm it’s really you.

Financial incentives. The CCPA allows us to offer fans financial incentives for sharing their personal information with us. We don’t do it very often, but we do sometimes offer perks if you give us your info. Perks like the mobile app rewards program, which we need personal information to offer, otherwise we have no way to track how many sweet rewards points you have! Another example is that we ask for your info to enter a contests or sweepstakes. Your participation in these types of things is always optional and you can head back up to the collection section of this privacy statement to understand the what and why.

E.U. Residents

The information in this section is for EU residents and supplements the disclosures in this privacy statement. If you are an EU resident and you express interest in developing a franchise, we collect the personal information described above in the “Developing a Franchise” section.

Data Controller. American Dairy Queen Corporation (ADQ) is the data controller for your personal information.

Lawful Basis for Processing. By submitting your personal information to us, you are consenting to our use and processing as described in this privacy statement. We may also process personal information because the processing is necessary for our legitimate business interests, for things such as: (1) providing, improving, and promoting the Sites, or our products and services; (2) communicating with potential franchisees and their individual points of contact; (3) other business development purposes; (4) sharing information within the DQ/Orange Julius family of companies, as well as with service providers and other third parties; and (5) maintaining the safety and security of our products, services, and employees.

Cross-Border Transfer. Since ADQ’s world headquarters are in the United States, this means any personal information you submit to us will be transferred to the U.S. By submitting personal information:

  1. you explicitly consent to the transfer of your personal information to the U.S.;
  2. you understand that no adequacy decision and no adequate safeguards apply to these transfers; and
  3. you understand that U.S. surveillance laws fundamentally clash with EU data protection rights, and that your personal information may become exposed to the U.S. government.

Retention. Our current retention practices are:
  1. any personal information kept in our email system will be deleted after 8 years; and
  2. for any of your personal information we keep in other systems, we’ll use some of the following factors to determine retention: legal requirements to retain data, retention obligations related to actual or potential litigation or government investigations, the date of our last communication together, whether you go on to become a franchisee, the sensitivity of the data, and the purposes for which the data was collected.

Your Rights. You have a variety of rights including the right to request access to, correction of, or deletion of your personal information, to restrict the processing or object to the processing of your personal information, or to get a copy of your personal information. There may be limitations on these rights. To exercise any of your rights, please email privacy@idq.com.

If You Don’t Give Us Your Personal Information. Giving us your personal information is a pre-contractual requirement to be considered for developing a franchise. If you don’t give us your personal information, we won’t be able to consider you for developing a franchise.

Withdrawal of Consent. You have the right to withdraw consent at any time, without affecting the lawfulness of the processing based on consent before withdrawal.

Make a Complaint. You have the right to lodge a complaint with your local Data Protection Supervisory Authority. Or you can contact ADQ at privacy@idq.com or using the contact information at the end of this privacy statement.
